A probate is the legal process by which a deceased person’s estate is administered and resolved after death. The person who administers the estate of another is a fiduciary and has legal obligations both to the heirs and beneficiaries of the estate and to its creditors. We have extensive experience in probate and non-probate administration, including solvent and insolvent estates, and testate and intestate matters (e.g. whether the deceased individual had a Last Will and Testament). Not every estate requires probate proceedings. We provide legal representation in both the formal and informal processes of final estate resolution.

• Identifying and providing required legal notice to the appropriate heirs, beneficiaries, and creditors of the estate
• Marshaling and valuing assets 
• Paying final debts, expenses and taxes 
• Resolving creditor claims and disputes against the estate
• Distributing assets to heirs and beneficiaries 

While Washington probate is often more streamlined than in other states, the process can still feel complex without proper guidance.

Do All Estates Go Through Probate?

Not always. If an estate has less than $100,000.00 in assets and no real property, it may qualify to be administered through a Small Estate process.  Additionally, certain assets may have been set up to pass outside probate through:

• Beneficiary designations
