Guradianship Representation
A guardianship and/or conservatorship is necessary when a person becomes unable to independently manage their own personal and/or financial affairs and there is no lesser restrictive alternative in place such as a power of attorney or trust that can provide necessary management and services for them. Any person interested in the welfare of another can petition the court for the appointment of a guardian and/or a conservator to protect a vulnerable person.
We will help you determine whether a guardianship and/or conservatorship is necessary and then either assist you throughout the court process or assist in facilitating an appropriate lesser restrictive alternative for the person in need of protection. We also represent both professional and lay guardians and conservators in meeting the ongoing statutory requirements and completing financial accountings and other required reports to the court. Additionally, we represent attorneys-in-fact serving under powers of attorney as well as trustees of individual and family trusts to ensure compliance with the law governing fiduciaries in Washington, including regular financial accounting.

What Is Guardianship and Conservatorship?
Guardianship and Conservatorship is a court-supervised legal arrangement that allows a trusted and qualified individual or entity to make personal, medical, and/or financial decisions for someone who is unable to do so independently. A guardianship refers to the exercise of powers and duties over a protected person’s individual care and needs, and a conservatorship refers to the exercise of powers and duties over a protected person’s finances and estate.
Individuals with the functional, mental, or physical inability to care for themselves and who do not have a power of attorney or other mechanism in place giving someone authority to act on their behalf may need a guardian and/or conservator to be appointed by the court.
This may include:
